Attorney Mary E. McSwain is a Founding Partner with McSwain Nagle Giese & Rapp, P.C. in Wheaton, IL. A general practitioner, Mary concentrates her practice in the areas of family law and residential real estate. Prior to opening her new firm of McSwain Nagle Giese & Rapp, P.C., Mary’s former law partner was Attorney Neal Cerne, who now is a sitting Judge in DuPage County.

As an accomplished trial attorney, Mary has written several appellate briefs that resulted in precedent-setting published opinions over several decades. With a Midwest work ethic second to none, Mary has developed a solid reputation as a tireless advocate for thousands of clients in family law and real estate transactions.

Mary has presented at numerous seminars sponsored by the DCBA, Chicago Title Insurance Company, and the Illinois Bar Association. She is also a registered title agent for several title insurance companies.

As past Chair of the DuPage County Real Estate Law and Practice Committee (1993-1994 and 2007-2008), Mary facilitated revisions to the regional residential real estate contract. She is also a longtime former member of the board of directors of the Illinois Real Estate Lawyers Association (IRELA) and the DuPage County Family Law Committee, as she has been for more than 25 years.

In addition, Mary was an elected member of the Illinois State Bar Association Assembly from 2004 to 2010. She has also served as an elected member of the board for the DuPage County Bar Association (DCBA) from 2000 to 2006. Utilizing her vast legal knowledge, Mary has chaired various committees for the Association, including Court Facilities and Law Practice Management Committees.

Active in the local legal community, Mary has been recognized for her outstanding work. She is a recipient of the DCBA Pro Bono Service Award 2005-2006 as well as the DCBA Board of Directors Award 1999-2000. She is rated 5/5 in the prestigious Martindale Hubbard peer review, as well as earning a rating of 10/10 by her clients on the widely recognized Avvo.com lawyer review website. 

After receiving her Bachelor’s degree from Loyola University Chicago, Mary earned her Juris doctorate degree from Northern Illinois School of Law. She was admitted to practice in both the State of Illinois and the Northern District of Illinois in 1983. More recently, Mary was admitted to practice before the United States Supreme Court in 2015.
